Judges
Pursuant to MCR 7.205(E)(2) and MCR 7.216(A)(7), and in lieu of granting the application
for leave to appeal, the April 9, 2026 order denying defendant’s motion to quash the information and
dismiss is VACATED in part and the case is REMANDED to the circuit court for consideration of
defendant’s first claim of error, which was not properly raised in the circuit court. More specifically, the
circuit court shall address defendant’s claim that the prosecutor failed to present evidence at the
preliminary examination that permitted an inference that defendant threatened to accuse someone of a
crime or other offense within the meaning of MCL 750.213. See People v Percin, 330 Mich 94, 98-99
(1951); People v Jones, 62 Mich 304, 306 (1886).
In all other respects, the application is DENIED for lack of merit to the extent that
defendant has argued that the prosecutor failed to present evidence at the preliminary examination to
establish the other elements of the crime of extortion, but DENIED for failure to persuade of the need for
immediate appellate review to the extent that defendant has argued that the district court misapplied the
law.
We do not retain jurisdiction.
