Docket No. 378174
LC No. 23-046427-FH

Presiding Judge

Judges
The motion to waive fees is GRANTED. The motion for leave to file brief in support of
the application for leave to appeal is also GRANTED.
On the Court’s own motion, this case is REMANDED to the trial court for appointment of
appellate counsel to represent defendant-appellant in this matter within 21 days after the date of this order.
The trial court shall send a copy of the order appointing appellate counsel to this Court within seven days
after entry. Appointed counsel shall file a supplemental brief in support of the application for leave to
appeal, or another appropriate filing, with this Court within 42 days after appointment.
The application for leave to appeal is HELD IN ABEYANCE until the supplemental brief
or other filing is filed with this Court by appointed appellate counsel.
_______________________________
Presiding Judge
Ackerman, J. (dissenting): I do not believe supplemental briefing is necessary to resolve the application
for leave to appeal and would decide the application on the existing record.
