Court of Appeals, State of Michigan
ORDER
IN RE BURGESS
Docket No. 378449
LC No. 25-002115-GC
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The complaint for superintending control and any accompanying motions are DISMISSED
for lack of jurisdiction. Pursuant to MCR 7.203(C)(1), this Court may “entertain an action for . . .
superintending control over a lower court or a tribunal immediately below it arising out of an action or
proceeding which, when concluded, would result in an order appealable to the Court of Appeals[.]”
(emphasis added.) Plaintiff seeks a writ of superintending control over a 27 th District Court Judge. The
district court is not a court immediately below this Court, and an order concluding those proceedings
would not be appealable directly to this Court. As such, this Court lacks jurisdiction over this complaint.
