Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V MICHAEL ANTHONY CLARK
Docket No. 381412
LC No. 05-004753-01-FH
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The delayed application for leave to appeal and motion to waive fees are DISMISSED for
lack of jurisdiction because appellant failed to file the application within six months of the date of entry
for the November 26, 2025 order as required by MCR 7.205(A)(4)(a). While defendant filed a motion for
reconsideration, which was denied on June 1, 2026, the motion for reconsideration was not filed in the
trial court “within the initial 21-day appeal period or within further time the trial court has allowed for
good cause during that 21-day period.” MCR 7.205(A)(1)(b). Accordingly, the due-date for the
application cannot be timed from the date of the June 1, 2026 order denying reconsideration.
