Court of Appeals, State of Michigan
ORDER
JEREMY BRIAN HEAVNER V CAITLIN JANE HEAVNER
Docket No. 381030
LC No. 2025-000330-DM
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The claim of appeal and “motion for immediate consideration to stay proceedings pending
appeal” are DISMISSED for lack of jurisdiction. The April 1, 2026 judgment of divorce is a final order
appealable by right. MCR 7.203(A)(1); MCR 7.202(6)(a)(i). However, the claim of appeal was
prematurely taken from the April 1, 2026 divorce judgment because when the claim of appeal was filed,
an order had not been entered deciding the postjudgment motions for relief. MCR 7.204(A)(1)(d).
Dismissal is without prejudice to whatever other relief may be available consistent with the court rules.
