The motion for immediate consideration is GRANTED.
Pursuant to MCR 7.205(E)(2), in lieu of granting the application for leave to appeal, the
April 27, 2026 order denying appellant’s motion to intervene is REVERSED and the case is REMANDED
to the Berrien Circuit Court for entry of an order granting appellant permissive intervention. Because
appellant met the requirements of MCR 2.209(B)(2), the trial court erred by denying the motion to intervene.
This order is to have immediate effect. MCR 7.215(F)(2).
We do not retain jurisdiction.
