Court of Appeals, State of Michigan
ORDER
STATE OF MICHIGAN V PATRICK OREILY-LIAM MALOY
Docket No. 382446
LC No. 26-002274-GZ; 26-048889-SM
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The motion to waive fees is GRANTED for this case only.
The application for leave to appeal, the motion for stay pending appeal, and the motion for
immediate consideration are DISMISSED for lack of jurisdiction because appellant seeks leave to appeal
an order entered by the 79th District Court. The order was signed by Judge Nellis in his role as chief
judge of the 79th District Court. See MCR 2.003(D)(3)(a)(i). This Court does not have jurisdiction over
appeals from the district court. MCR 7.203(B). Rather, appellate jurisdiction lies in the 51st Circuit
Court. See MCL 600.8342(1) (“Appeals from the district court shall be to the circuit court in the county
in which the judgment is rendered.”); MCR 7.103(B).
