Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V FREDERICK MARTEZ MARTIN
Docket No. 378771
LC No. 09-023095-01-FC
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.211(E)(2), orders:
The motion for reconsideration is GRANTED in part, as follows. The order dated February
11, 2026, is VACATED, and the delayed application for leave to appeal is REINSTATED. Counsel may
not file an amended application for leave to appeal without first filing a motion seeking leave to do so, see
IOP 7.212(C), and must duly e-serve the prosecution, via MiFILE, at its recently updated e-service
address: wcpaappeals@waynecountymi.gov. See IOP 7.205(B)(5). Within 7 days of this order’s entry,
counsel shall duly e-serve the prosecution at that address with a copy of the delayed application that was
filed in this Court on December 22, 2025.
On the Court’s own motion pursuant to MCR 7.216(A)(7), defendant’s retained counsel,
Phillip Comorski (P46413), is assessed sanctions in the amount of $500 for allowing this appeal to be
dismissed for failure to cure the filing defect—and again failing to cure it before moving for
reconsideration of this Court’s dismissal order. Counsel shall pay those sanctions to the Clerk of this
Court within 21 days of this order’s entry. The sanctions are personal to the attorney and shall not be
charged back to the client.
