IN ABEYANCE until this Court decides the pending appeals in People of MI v Kenneth Aaron Malone,
COA Docket No. 331903, and People of MI v Dameon Michael-James Spencer, COA Docket No. 376714.
Thereafter, in accordance with the Supreme Court order, we will reconsider the decision in our October
17, 2022 order in light of People v Kardasz, ___ Mich ____; ___ NW2d ___ (MSC Docket No. 165008,
decided December 19, 2025), and this Court’s decisions in Malone and Spencer.
