Court of Appeals, State of Michigan
ORDER
SPRING CREEK FAMILY REVOCABLE TRUST V GERALD CLARKE
Docket No. 379484
LC No. 2025-011366-CH
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction because the January 26, 2026
trial court order is not a final order appealable of right. MCR 7.202(6)(a); MCR 7.203(A). That order is
not a final order under MCR 7.202(6)(a)(i) because it does not fully dispose of the claims and adjudicate
the rights and liabilities of the parties since it leaves open determination of the parties’ respective
obligations as to the costs for repair and maintenance of South Sandy Beach Road. Dismissal is without
prejudice to the filing of an application or delayed application for leave to appeal under MCR 7.205,
provided such a filing meets all requirements under the court rules and is not time-barred. Alternatively,
appellants may be able to timely file a claim of appeal after entry of a final judgment or order under MCR
7.202(6)(a)(i).
