Judges
Pursuant to MCR 7.205(E)(2) and MCR 7.216(A)(7), and in lieu of granting the delayed
application for leave to appeal, the December 12, 2025 order denying defendant’s motion to suppress is
VACATED and the case is REMANDED to the trial court for reconsideration of that motion. On
reconsideration, the trial court shall determine whether there were unusual circumstances that warranted
appointing counsel for the photo lineup. See People v McKenzie, 205 Mich App 466, 472 (1994); People
v Cotton, 38 Mich App 763, 767-768 (1972). The trial court shall hold an evidentiary hearing, if necessary,
to resolve any factual disputes affecting that determination.
We do not retain jurisdiction.
