Magistrate Judge (ECF No. 39) is APPROVED and ADOPTED as the opinion of the Court.
IT IS FURTHER ORDERED that defendants’ motions to dismiss (ECF No. 28, 31) are
GRANTED and plaintiff’s complaint is DISMISSED.
