Jose Aguila,
Appellant,
vs.
State of Florida,
Appellee.
An Appeal under Florida Rule of Appellate Procedure 9.141(b)(2) from
the Circuit Court for Miami-Dade County, Carlos Gamez, Judge.
Michael A. Pizzi, Jr., P.A., and Michael A. Pizzi, Jr., for appellant.
James Uthmeier, Attorney General, and Daihana Chang, Assistant
Attorney General, for appellee.
Before SCALES, C.J., and GORDO and GOODEN, JJ.
PER CURIAM.
Appellant Jose Aguila challenges the trial court’s summary denial of
his motion for post-conviction relief under Florida Rule of Criminal Procedure
3.850. He asserts that his first defense counsel—who represented him
before he voluntarily pled guilty while represented by court-appointed
counsel—was ineffective for various reasons. But he cannot assert claims
that attempt to go behind the plea. See Stano v. State, 520 So. 2d 278, 280
(Fla. 1988); Dean v. State, 580 So. 2d 808, 810 (Fla. 3d DCA 1991). That
plea is a break in the chain of events that came before it. Tollett v.
Henderson, 411 U.S. 258, 267 (1973). For that reason, the trial court
properly summarily denied his motion.
Affirmed.
