STATE OF CALIFORNIA DECISION OF THE PUBLIC EMPLOYMENT RELATIONS BOARD BUTTE COUNTY PART-TIME FACULTY ASSOCIATION, COMMUNICATION WORKERS OF AMERICA, Charging Party, v. BUTTE COMMUNITY COLLEGE DISTRICT, Respondent. ) ) ) ) ) ) ) ) ) ) ) ____________________ ) Case No. S-R-836 Request for Remand PERB Order No. Ad-196 September 27, 1989 Appearance: Brown & Conradi by William E. Brown, Attorney, for Butte Community College District. Before Hesse, Chairperson; Porter and Shank, Members. DECISION HESSE, Chairperson: On June 13, 1989, pursuant to a proposed settlement agreement between Butte Community College District (District) and Butte County Part-Time Faculty Association, Communication Workers of America, the Sacramento Regional Director of the Public Employment Relations Board (PERB or Board) requested that the Board remand the above-captioned case to the Sacramento Regional Office to resolve the pending representation matter. As the District has filed exceptions to the Board agent's proposed decision, this case is presently pending before the Board. However, the Board has considered the request for remand and concurs that a remand is in the best interest of the parties and is consistent with the purposes of the Educational Employment Relations Act section 3540 et seq. Pursuant to Long Beach Community College District (1989) PERB
Decision No. 765, and in furtherance of the parties' proposed settlement agreement, the Board grants the request to remand Butte Community College District, Case No. S-R-836 to the Sacramento Regional Director. Pending implementation of the parties' proposed settlement and the District's request to withdraw, with prejudice, its exceptions to the proposed decision, the Board holds the exceptions to Case No. S-R-836 in abeyance. ORDER IT IS HEREBY ORDERED that Case No. S-R-836 is REMANDED to the PERB Sacramento Regional Director for the purpose of implementing a proposed settlement agreement. The exceptions in Case No. S-R-836 are hereby held in abeyance. Members Porter and Shank joined in this Decision. 2
