Omnilex-Zusammenfassung

The Federal Administrative Court upheld the complaint of the intervener against non-admission of revision. It held that the case is of fundamental importance because it requires clarification whether the Telecommunications Act leaves the Federal Network Agency any margin of appreciation when determining the costs of efficient service provision, particularly as to hourly rates underlying one-time charges, and how courts must review such determinations. The court also fixed the dispute value for the complaint and provisional revision proceedings.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a case in telecom fee regulation concerning the determination of costs of efficient service provision and the judicial review of the Federal Network Agency’s methodology; revision is to be admitted where clarification is required as to whether the Telecommunications Act grants any assessment margin in fixing hourly rates underlying one-time charges and according to which standards courts are to control that determination (consid. 1). Dispute value is determined under §§ 47, 52, 63 GKG where the court expressly fixes it for the complaint and provisional revision proceedings.
