Omnilex-Zusammenfassung

The Federal Administrative Court held that the interested party’s complaint against the refusal to admit revision was well founded. The case raises a question of fundamental importance: whether the Telecommunications Act gives the Federal Network Agency a margin of appreciation when determining efficient-service costs and the hourly rates underlying one-time charges, and by which standards courts review those determinations. Revision was therefore admitted. The court also fixed the value in dispute for the complaint and the provisional revision proceedings.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility for fundamental importance in telecom charge regulation; the complaint against non-admission is successful where the appeal presents an unresolved legal question capable of clarification in revision. A fundamental question exists where it is uncertain whether the Telecommunications Act grants the Federal Network Agency a margin of appreciation in the determination of efficient-service costs and the hourly rates underlying one-time charges, and what standard of judicial review applies. The existence of such a need for clarification suffices for admission; the merits of the underlying charge decision are not yet decided (consid. 1).

Kernrechtsfrage

Whether revision should be admitted because the case raises a question of fundamental importance under § 132(2) No. 1 VwGO regarding BNetzA's discretion and judicial review in determining efficient-service costs and hourly rates for one-time charges.

Extrahierter Entscheid

Yes. The complaint is well-founded because the case can clarify whether, and to what extent, the Telecommunications Act grants the Federal Network Agency a margin of appreciation in calculating efficient-service costs and the relevant hourly rates, and how courts must review those determinations.

Extrahierte Begründung

The unresolved legal question concerns the scope of any assessment margin in the cost calculation under §§ 31(2) and 32(1) TKG and the standard of judicial review; this is suitable for clarification in revision.
