Omnilex-Zusammenfassung

The Federal Administrative Court granted the Beigeladene's complaint against non-admission of revision. It held that the case raises a question of fundamental importance: whether, and to what extent, the Telecommunications Act leaves the Bundesnetzagentur an assessment margin when determining efficient service costs and the hourly rates underlying one-time charges, and what standards govern judicial review. The court also fixed the dispute value for the complaint and provisional revision proceedings.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a non-admission complaint in telecommunications fee regulation: A case is of fundamental importance where it may clarify whether the Telecommunications Act grants the Bundesnetzagentur an assessment margin in determining the costs of efficient service provision and the hourly rates used for one-time charges, and according to which standards courts review such determinations. The admissibility of revision depends on the abstract need for clarification of an unresolved legal question of general significance (consid. 1).
