Omnilex-Zusammenfassung

The claimant's complaint against the non-admission of revision succeeded. The Federal Administrative Court held that the case has fundamental importance because it may clarify how, in a damages claim for unlawful failure to promote, possibly unlawful staffing-note requirements in the federal budget are to be considered when determining the hypothetical causal course. The court also addressed the value of the subject matter for costs purposes.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance in a damages action based on unlawful failure to promote; the need for clarification exists where the appeal raises whether, in reconstructing the hypothetical causal course, potentially unlawful staffing-note requirements linked to minimum periods of service must be taken into account when bundled posts are allocated. The question is suitable for review by the Federal Administrative Court when its resolution may affect the method of causal assessment in comparable promotion-damages disputes (consid. 1).
