Omnilex-Zusammenfassung

The Federal Administrative Court upheld the complaint against non-admission of revision in a municipal supervision dispute. It held that the case raises a question of fundamental importance: whether it is compatible with the guarantee of municipal self-government that the appellate court treated proportionality as irrelevant and left open whether the municipality's financial distress was caused by the authority's failure to secure adequate funding. The complaint was therefore successful.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; municipal supervision and the guarantee of local self-government under Art. 28 Abs. 2 sentence 2 GG and Art. 137 para. 5 Hessian Constitution; revision is to be admitted where the appellate court has left unresolved whether a municipality's financial emergency is attributable to the supervising authority's failure to secure the financial means required for the performance of self-administered and delegated tasks. The constitutional compatibility of disregarding proportionality in that context constitutes a question of fundamental importance warranting clarification in revision (consid. 1).

Yes. The complaint succeeded because the legal question whether the appellate court's approach is compatible with municipal self-government is of fundamental importance.

Extrahierte Begründung

The appellate court treated proportionality as irrelevant and left open whether the alleged budget crisis resulted from the defendant's failure to secure adequate financial resources under the Hessian constitution. The Federal Administrative Court held that this constitutional compatibility question must be clarified in revision.
