Omnilex-Zusammenfassung

The Federal Administrative Court granted the complainant’s challenge against the refusal to admit revision. It held that the case raises a question of fundamental importance: whether and on what conditions a civil servant employed at an ARGE may be reassigned under § 44g SGB II to a joint institution against his or her will, and how the statutory concept of an 'important reason' for termination under § 44g Abs. 5 S. 1 Nr. 2 SGB II is to be construed.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; leave to appeal for fundamental importance concerning reassignment of civil servants under § 44g SGB II. A complaint against non-admission of revision is well-founded where the appeal raises an unresolved question of general significance requiring clarification in revision proceedings. Fundamental importance may lie in the interpretation of whether reassignment to a joint institution under § 44g Abs. 1 S. 1 SGB II can occur against the civil servant’s will and in the scope of the termination ground of an 'important reason' under § 44g Abs. 5 S. 1 Nr. 2 SGB II. The threshold is met where the legal question is open and capable of being clarified in the revision procedure.

Titelzeile

Kernrechtsfrage

Whether leave to appeal should be granted for the question if a civil servant may be reassigned to a joint institution against his or her will under § 44g SGB II and how 'important reason' in § 44g Abs. 5 S. 1 Nr. 2 SGB II is to be interpreted.

Extrahierter Entscheid

Yes. The case raises a question of fundamental importance, so revision had to be allowed.

Extrahierte Begründung

The complaint was admissible and well-founded because the proposed appeal could clarify an unresolved, general legal question concerning the scope of reassignment under § 44g Abs. 1 S. 1 SGB II and the meaning of the statutory termination ground in § 44g Abs. 5 S. 1 Nr. 2 SGB II.
