Omnilex-Zusammenfassung

The Federal Administrative Court upheld the complaint against denial of leave to appeal and admitted the revision. The case concerns whether § 172(1)(1) BauGB can serve as a legal basis for a preservation bylaw intended to maintain existing block-edge development because of its noise-buffering effect. The court found that this question merits further clarification in revision. It also provisionally fixed the amount in dispute for the revision proceedings under the GKG provisions cited.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; admissibility of revision for clarification of whether § 172 Abs. 1 Satz 1 Nr. 1 BauGB may justify an urban preservation bylaw aimed at retaining existing block-edge development solely because of its noise-screening function; fundamental significance is present where the contested legal question has not yet been clarified and the revision can contribute to its development (consid. 1). The provisional amount in dispute is determined under §§ 47 Abs. 1 Satz 1, 52 Abs. 1 and 63 Abs. 1 Satz 1 GKG.
