Omnilex-Zusammenfassung

The Federal Administrative Court upheld the defendant’s complaint and admitted the revision. It held that the case raises a question of fundamental significance: how the Federal Office must respond in proceedings challenging the termination of asylum proceedings under Sections 33 and 32 AsylVfG when it becomes aware of a foreign recognition of refugee status, and what this means for any decision on deportation protection. The court therefore did not need to decide the other grounds for admission.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; revision admission for fundamental significance in asylum proceedings concerning termination under §§ 32, 33 AsylVfG and later knowledge of a foreign refugee recognition. A matter has fundamental significance where it presents a legally clarifiable question that is capable of general development of the law. In such a situation, the court may admit the revision without examining further admission grounds. The question whether the Federal Office must react to the subsequent emergence of a foreign refugee recognition, and how this affects the ordering of deportation protection, can justify revision admission if it has relevance beyond the individual case.
