The Federal Administrative Court granted leave to appeal on the ground of fundamental significance. It held that the revision could help clarify the prerequisites for finding predominant opinion power under § 26(1) RStV. The order also set the dispute value for the complaint proceedings and the provisional value for the revision proceedings.
§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility for fundamental significance in assessing predominant opinion power under § 26 Abs. 1 RStV; a case has fundamental significance where the revisional proceedings may serve to clarify unresolved requirements for the assumption of predominant opinion power. The granting of leave to appeal is justified when the question is not yet sufficiently clarified in the case law and is capable of general clarification in the revision proceedings (consid. 1).

1 Die Revision ist jedenfalls gemäß § 132 Abs. 2 Nr. 1 VwGO wegen grundsätzlicher Bedeutung der Rechtssache zuzulassen. Das Revisionsverfahren kann dem Senat Gelegenheit geben, die Voraussetzungen für die Annahme vorherrschender Meinungsmacht im Sinne von § 26 Abs. 1 RStV weiterer Klärung zuzuführen.
2 Die Streitwertfestsetzung für das Beschwerdeverfahren folgt aus § 47 Abs. 1 Satz 1 und Abs. 3, § 52 Abs. 1 GKG; die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 47 Abs. 1, § 52 Abs. 1 i.V.m. § 63 Abs. 1 Satz 1 GKG.
