Omnilex-Zusammenfassung

The Federal Administrative Court upheld the defendant’s complaint against the non-admission of revision. It found that the case raises a question of fundamental importance: whether a treaty rule on a state subsidy for Jewish communities can be interpreted in a way that leaves decisive distribution criteria to the exclusive assessment of a third party, and whether this is compatible with the judicial guarantee under Articles 20(3) and 92 GG.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a case exists where the appeal would clarify a legally unresolved question capable of general clarification. This may also be the case when the compatibility of an interpretation of a treaty-based subsidy regime with the judicial guarantee under Art. 20 Abs. 3 GG in conjunction with Art. 92 GG is in dispute, particularly if essential determining criteria are assigned to the exclusive assessment of a third party. The admissibility threshold is met when the legal question is formulated in a generalizable manner and is decisive for the outcome (consid. 1).
