The Federal Administrative Court upheld the defendant’s complaint against the North Rhine-Westphalia Higher Administrative Court’s judgment. It held that the case raises questions of fundamental importance under § 132(2) No. 1 VwGO: whether the assessment of the sports betting monopoly’s practical design as to advertising must be uniform across Germany or may vary by Land, and whether compatibility with the EU-law coherence requirement depends on an assessment of migration effects into other gambling sectors. Because the fundamental-importance ground was sufficient, the court did not need to address the asserted grounds under § 132(2) Nos. 2 and 3 VwGO.
§ 132 Abs. 2 Nr. 1 VwGO; revision leave on fundamental importance in sports betting monopoly cases; the requirement of legal clarification is met where unresolved questions concern the standard of review for the practical design of the state sports betting monopoly, in particular advertising, and the relationship between EU-law coherence and the constitutional autonomy of the Länder under Art. 20(1), Art. 79(3) and Art. 23(1) sentence 3 GG. If the complaint shows that such questions are decisive, leave to appeal must be granted; alternative grounds under § 132 Abs. 2 Nos. 2 and 3 VwGO need not be examined.

Revisionszulassung; zur Zuständigkeit für die Prüfung der tatsächlichen Ausgestaltung des staatlichen Sportwettenmonopols hinsichtlich der Werbung
1 Die Beschwerde der Beklagten hat Erfolg. Der Rechtssache kommt bezüglich beider die Entscheidung tragender Begründungselemente grundsätzliche Bedeutung im Sinne von § 132 Abs. 2 Nr. 1 VwGO zu. Die Beschwerdebegründung führt auf die klärungsbedürftigen Fragen,
ob die Prüfung der tatsächlichen Ausgestaltung des staatlichen Sportwettenmonopols hinsichtlich der Werbung am Maßstab des unionsrechtlichen Kohärenzerfordernisses bundeseinheitlich oder wegen der vom Grundgesetz gewährleisteten Eigenständigkeit der Länder (Art. 20 Abs. 1, Art. 79 Abs. 3 i.V.m. Art. 23 Abs. 1 Satz 3 GG) länderspezifisch zu erfolgen hat und
ob die Vereinbarkeit des staatlichen Sportwettenmonopols mit dem unionsrechtlichen Kohärenzerfordernis von einer Folgenabschätzung im Sinne einer Wanderbewegung hin zu liberaler geregelten anderen Glücksspielbereichen abhängt.
2 Auf die Zulassungsgründe des § 132 Abs. 2 Nr. 2 und 3 VwGO kommt es im Hinblick auf die erfolgreiche Grundsatzrüge nicht an.
