Zusammenfassung

The Federal Administrative Court granted leave to appeal against the Baden-Württemberg Administrative Court judgment. It held that the case could clarify, under § 132(2) No. 1 VwGO, the requirements for a legally valid determination of fixed reimbursement ceilings for expenses for medicinal products under § 22(1) BBhV.

Regest

§ 132 Abs. 2 Nr. 1 VwGO; revision admission for fundamental importance: A case has fundamental significance where it is capable of clarifying the requirements for a legally effective determination of fixed amounts as an upper limit for the beihilfefähigkeit of expenses for medicinal products. It is sufficient that the proposed revision can contribute to the clarification of an unresolved legal question of general importance; the court need not already decide the merits at the admission stage.
