BVerwG 8 B 91/11, 8 B 91/11 (8 C 10/12) ΓÇó Revision admitted in sport betting monopoly case
BVerwG 8 B 91/11, 8 B 91/11 (8 C 10/12)Bverwg / Division 816.02.2012Granted
The Federal Administrative Court upheld the defendant’s complaint for admission of revision in a dispute concerning the state sports betting monopoly and advertising. It held that the case raises questions of fundamental importance under Section 132(2)(1) VwGO, namely whether the coherence review of the monopoly’s advertising must be conducted uniformly nationwide or state-specifically, and whether coherence depends on an effects assessment regarding shifts toward more liberal gambling sectors. The court stated that, because this ground was sufficient, it did not need to address the additional grounds under Section 132(2)(2) and (3) VwGO.
§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a complaint for admission of revision in a dispute concerning the state sports betting monopoly and advertising; questions on the territorial standard of coherence review and on the relevance of a migration/side-effects assessment are capable of clarification. The complaint succeeds where the applicant identifies unsettled questions of law requiring clarification for the revision proceedings (consid. 1). If this ground is established, examination of the remaining admission grounds under § 132 Abs. 2 Nr. 2 and 3 VwGO is unnecessary (consid. 2).
