Omnilex-Zusammenfassung

The Federal Administrative Court admitted the revision against a Bavarian Administrative Court judgment in a broadcasting-licence dispute. It held that the case raises a question of fundamental significance: whether, and under what circumstances, a broadcaster may invoke proportionality and the fundamental rights to broadcasting freedom and occupational freedom to continue using the remaining term of a licence after changes of 50% or more in the ownership and participation structure of the provider company. The court also fixed the value of the appeal and provisional revision proceedings.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; revision is admissible where a case presents a question of fundamental significance not yet sufficiently clarified in the court's case law. A question is fundamental where its answer is capable of contributing to the development or uniform application of law, here concerning whether major changes in the ownership and participation structure of a broadcasting company may, in light of proportionality and Art. 5(1) sentence 2 GG and Art. 12(1) GG, justify a right to exploit the remaining term of a broadcasting licence. The abstract legal question must be decisive for the dispute and go beyond the individual case.

§ 63 Abs. 1 Satz 1 GKG.

The revision was admitted because the case raises a question of fundamental significance that is not yet sufficiently clarified in the court's case law.

Extrahierte Begründung

The unresolved question concerns whether, in light of proportionality and the fundamental rights under Art. 5(1) sentence 2 GG and Art. 12(1) GG, a right to use the remaining licence term can arise after such ownership changes.
