Omnilex-Zusammenfassung

The Federal Administrative Court upheld the complaint against the refusal to admit revision in a dispute concerning the teaching load of a university professor. It held that the case has fundamental importance because it may clarify when a professor’s own teaching offers must be credited toward the teaching obligation and whether an excess teaching offer can require a reduction of that obligation in light of academic freedom under Art. 5(3) GG. The court also set the dispute value for the complaint and provisional revision proceedings.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; Art. 5 Abs. 3 GG; admission of revision for fundamental importance in cases concerning university teaching duties. A complaint against non-admission of revision is well-founded where the dispute is capable of clarifying, in abstract and general terms, the conditions under which teaching events offered by a university lecturer are to be credited against the teaching obligation and whether an excess teaching offer may necessitate a reduction of that obligation. The requisite fundamental importance may arise from the need to delineate the scope of academic freedom in relation to statutory teaching duties (consid. 1).

Kernrechtsfrage

Whether revision should be admitted for a case on counting university teaching offerings toward a professor’s teaching obligation in light of academic freedom.

Extrahierter Entscheid

Yes. The case raises a question of fundamental importance that can clarify when lectures offered by a professor count toward the teaching obligation and when an excess teaching offer requires reducing that obligation.

Extrahierte Begründung

The court found that clarification was needed under Art. 5(3) GG regarding the relationship between academic freedom and the allocation of teaching duties; this satisfied the requirement of fundamental significance under § 132(2) no. 1 VwGO.
