Omnilex-Zusammenfassung

The Federal Administrative Court granted leave to appeal on grounds of fundamental importance. It held that the case could clarify whether a reliability review under § 4(3) WaffG is required when the previous review was not prompted by a personal reason and only around two years had passed, and whether the prior grant or renewal of an annual hunting license, which itself requires a reliability assessment under § 17(1) sentence 2 BJagdG, affects that requirement.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance; a case has fundamental significance where the proposed revision is capable of clarifying a question of federal law not yet sufficiently settled in the court’s case law. This is so in particular where the disputed issue concerns whether a reliability review under § 4(3) WaffG is required despite a prior non-person-specific review and a relatively short lapse of time since the last routine review, and whether the prior issuance or renewal of an annual hunting license, which presupposes a reliability assessment under § 17(1) sentence 2 BJagdG, bears on that requirement (consid. 1).

Kernrechtsfrage

Whether revision should be admitted because the case has fundamental importance regarding the need for a review under § 4(3) WaffG after an anonymous review and after issuance or renewal of a yearly hunting license.

Extrahierter Entscheid

Revision admitted because the unresolved questions could contribute to clarifying the case law of the Federal Administrative Court.

Extrahierte Begründung

The proposed revision could answer questions not yet sufficiently clarified in the court's jurisprudence, namely whether a review under § 4(3) WaffG is required when it was conducted without a personal trigger and only about two years had elapsed since the last routine review, and whether a prior annual hunting license, which also presupposes a reliability review, affects that requirement.
