Omnilex-Zusammenfassung

The Federal Administrative Court granted the claimant leave to appeal. It held that the case raises a question of fundamental importance under Section 132(2)(1) VwGO, namely whether the self-service ban for pharmacy-only, non-prescription medicines in Section 17(3) ApoBetrO 1987 is compatible with Articles 12(1) and 3(1) GG after mail-order sales of medicines were permitted.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of the case may lie where the appeal offers an opportunity to clarify whether § 17 Abs. 3 ApoBetrO 1987, which prohibits self-service for pharmacy-only medicines, remains compatible with Art. 12 Abs. 1 and Art. 3 Abs. 1 GG following the statutory authorization of mail-order pharmacy. A question of constitutional and regulatory consistency requiring clarification in revision suffices for leave to appeal.
