It is sufficient that the court of revision must clarify whether personal contact by an examinee with the examiner in objection or internal review proceedings, for the purpose of obtaining an explanation of the assessment, can constitute a breach of the federal requirement of equal treatment in examinations and, by reason of its weight, justify grading the work as insufficient as a proportionate sanction in light of Art. 12 GG (consid. 1).

Gründe

1 Die Beschwerde der Klägerin gegen die Nichtzulassung der Revision ist begründet. Die Rechtssache hat die geltend gemachte grundsätzliche Bedeutung im Sinne des § 132 Abs. 2 Nr. 1 VwGO. Sie wirft die klärungsbedürftige Frage auf, ob eine persönliche Kontaktaufnahme des Prüflings mit dem Prüfer im Widerspruchs- oder verwaltungsinternen Kontrollverfahren mit dem Anliegen, die Bewertung einer Arbeit durch den Prüfer erläutert zu erhalten, sich als Verletzung des bundesrechtlichen Gebots der Chancengleichheit im Prüfungsverfahren darstellt, die nach ihrem Gewicht eine Bewertung der Arbeit mit ungenügend als eine vor dem Grundrecht der Berufsfreiheit verhältnismäßige Sanktion erscheinen lässt.

2 Die Festsetzung des Streitwerts beruht für das Beschwerdeverfahren auf § 47 Abs. 1 und 3, § 52 Abs. 1 GKG, für das Revisionsverfahren auf § 47 Abs. 1, § 52 Abs. 1, § 63 Abs. 1 Satz 1 GKG.
