Gründe

1 Der Einwand des Klägers zu 4 gegen seine Mithaftung gemäß der Kostenrechnung vom 31. März 2011 ist als Erinnerung im Sinne von § 66 Abs. 1 des Gerichtskostengesetzes (GKG) zu werten.

2 Die Erinnerung hat keinen Erfolg. Die Kostenrechnung ist nicht zu beanstanden.

3 Nach dem Beschluss des Senats vom 25. Februar 2011 - BVerwG 8 B 83.10 - tragen die Kläger die Kosten des von ihnen eingeleiteten Beschwerdeverfahrens. Der Kläger zu 4 haftet dabei nach § 32 Abs. 1 Satz 1 GKG als Gesamtschuldner für die Gerichtskosten. Seine Haftung ergibt sich aus § 421 Satz 1 BGB. Danach kann der Gläubiger die Leistung nach seinem Belieben von jedem der Schuldner ganz oder zu einem Teil fordern. Er hat die freie Wahl, den Schuldner auszusuchen und braucht auch auf niemanden Rücksicht zu nehmen.

4 Ist Gläubiger die Staatskasse - wie im vorliegenden Fall -, dann wird dieses "Belieben" durch die Kostenverfügung (KostVfG) gesteuert, die als Verwaltungsvorschrift die Staatskasse in ihrem Ermessen bei der Auswahl des Schuldners bindet.

5 Die Kostenbeamtin hat § 8 Abs. 3 KostVfG beachtet. Demzufolge hat sie Kosten nach Kopfteilen von allen Kostenschuldnern eingefordert. Die Staatskasse braucht das Innenverhältnis der Kostenschuldner nicht zu kennen oder gar zu ermitteln (vgl. Hartmann, Kostengesetze, 41. Aufl., Rn. 3 bis 5 zu § 32 GKG).

6 Die Inanspruchnahme der Kostenschuldner nach Kopfteilen gemäß § 8 Abs. 3 Nr. 3 KostVfG mit der Kostenrechnung vom 31. März 2011 ist weder dem Grunde noch der Höhe nach zu beanstanden.
