BVerwG 6 B 43/10, 6 B 43/10 (6 C 8/11) ΓÇó Revision allowed for fundamental significance of challengeability of exam notices
BVerwG 6 B 43/10, 6 B 43/10 (6 C 8/11)Bverwg / 6. Abteilung15.03.2011Granted
The Federal Administrative Court upheld the complainant's challenge to the non-admission of revision. It held that the case has fundamental significance because it may clarify the question whether examination notices are challengeable, especially as regards the assessment of examination components. The decision also contains the cost-based value determinations for the complaint and the revision proceedings.
§ 132 Abs. 2 Nr. 1 VwGO; revision leave for fundamental significance: A complaint against denial of leave to appeal is justified where the case raises a question of fundamental importance requiring further clarification in revision. This may be the case in particular where the extent to which examination notices are challengeable, especially with respect to the assessment of individual examination parts, remains unresolved and is capable of general clarification (consid. 1).
