Omnilex-Zusammenfassung

In a non-admission complaint in a telecom regulation case, the Federal Administrative Court held that the matter has fundamental importance. The unresolved question was whether a temporary approval of wholesale access charges gives competitors reliance protection with respect to a later approval of higher charges for the remaining period. The complaint by the third party was therefore successful.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance in leave-to-appeal proceedings. A complaint against refusal of leave to appeal is justified where the case is capable of clarifying a legally unresolved question of general significance. In regulated telecommunications pricing, this may be the case where it is unclear whether a time-limited approval of wholesale charges affords competitors reliance protection for the later approval of higher charges for the residual period (consid. 1).

§ 52 Abs. 3, § 63 Abs. 1 Satz 1 GKG).

Extrahierte Begründung

The court found that the unresolved reliance-protection question in regulated telecom pricing has significance beyond the individual case and can guide future cases.
