Omnilex-Zusammenfassung

The Federal Administrative Court upheld the complaint against the refusal to admit revision. It held that the case raises a question of fundamental importance: what legal significance attaches to a traffic restriction measure under § 45(9) sentence 3 StVO when it not only diverts toll-avoiding traffic but also restricts heavy goods traffic already present on the route. The court indicated that the revision would likely permit further clarification in light of its earlier judgment in BVerwG 3 C 18.07.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a complaint against denial of leave to appeal in a traffic-restriction case under § 45 Abs. 9 S. 3 StVO. A question is of fundamental importance where the revision proceedings are likely to afford an opportunity to clarify, in a legally significant way, the scope and limits of a traffic measure whose effects extend beyond diverting toll-avoidance traffic and also reach pre-existing heavy-lorry traffic on the route. The decisive point is the unresolved legal significance of that additional restrictive effect; continuation of prior case-law may be required (consid. 2).

The revision proceedings will likely allow further clarification, in continuation of BVerwG 3 C 18.07, of the legal significance of the fact that a measure based on § 45(9) sentence 3 StVO not only diverts toll-avoiding traffic but also restricts heavy-lorry traffic already using the route.
