Gründe

1 Die Beschwerde der Klägerin ist begründet. Die Rechtssache hat grundsätzliche Bedeutung im Sinne des § 132 Abs. 2 Nr. 1 VwGO.

2 Das Revisionsverfahren kann Gelegenheit zur Klärung der Frage bieten, ob der pharmazeutische Unternehmer nach Ablauf einer Mängelbeseitigungsfrist im Sinne des § 105 Abs. 5 AMG daran gehindert ist, den Anspruch auf Verlängerung der fiktiven Zulassung darauf zu stützen, dass das Arzneimittel gemäß § 105 Abs. 4c AMG in einem anderen Mitgliedstaat der Europäischen Union zugelassen ist. Die Frage hat fallübergreifende Bedeutung. Nach Angaben der Beteiligten sind weitere verwaltungsgerichtliche Verfahren rechtshängig, in denen über diese Rechtsfrage gestritten wird. Darüber hinaus betrifft die Rechtsfrage alle noch nicht bestandskräftig abgeschlossenen Nachzulassungsverfahren, in denen eine Zulassung in einem anderen Mitgliedstaat noch geltend gemacht werden könnte.

3 Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 47 Abs. 1 i.V.m. § 52 Abs. 1 und § 63 Abs. 1 Satz 1 GKG.
