Gründe

1 Die Revision des Klägers ist zuzulassen, weil die mit der Nichtzulassungsbeschwerde aufgeworfene Frage, ob das Begehren eines erhöhten Auslandszuschlags eine zeitnahe Geltendmachung voraussetzt, grundsätzliche Bedeutung i.S.v. § 132 Abs. 2 Nr. 1 VwGO hat.

2 In der Rechtsprechung des Bundesverwaltungsgerichts ist zwar geklärt, dass Ansprüche, deren Festsetzung und Zahlung sich nicht unmittelbar aus dem Gesetz ergeben, einer vorherigen Geltendmachung bedürfen (vgl. zuletzt BVerwG, Urteil vom 17. September 2015 - 2 C 26.14 - Buchholz 232.0 § 87 BBG 2009 Nr. 1 Rn. 26). Ob dies auch für die durch Rechtsverordnung bestimmte Stufenzuordnung des Auslandszuschlages gilt, wird in der obergerichtlichen Rechtsprechung indes uneinheitlich entschieden (vgl. die vorliegende Entscheidung des VGH Mannheim, Urteil vom 8. März 2016 - 4 S 758/15 - einerseits; OVG Koblenz, Urteil vom 16. Dezember 2015 - 10 A 10945/15 - andererseits).

3 Das Verfahren gibt dem Bundesverwaltungsgericht daher Gelegenheit, die rechtlichen Voraussetzungen für das Begehren, den Auslandszuschlag nach einer anderen Stufenzuordnung zu erhalten, näher zu klären.

4 Die Streitwertfestsetzung für das Beschwerdeverfahren folgt aus § 47 Abs. 1 Satz 1 und Abs. 3, § 52 Abs. 1 GKG; die vorläufige Festsetzung des Streitwerts für das Revisionsverfahren beruht auf § 63 Abs. 1 Satz 1 i.V.m. § 47 Abs. 1 Satz 1, § 52 Abs. 1 GKG.
