Omnilex-Zusammenfassung

The Federal Administrative Court granted leave to appeal in a dispute concerning fire-service shift work and the conditions for a member-state opt-out allowing voluntary overtime beyond 48 hours per week. The court found that the complaint raised a question of fundamental importance under § 132(2)(1) VwGO, namely what requirements Article 22(1) of Directive 2003/88/EC sets for such an opt-out rule. No substantive merits ruling on the underlying employment dispute was made.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; Art. 22 Abs. 1 RL 2003/88/EG: Revision is to be admitted where a complaint raises a question of fundamental significance requiring clarification in the revision proceedings. This is the case, in particular, where the appeal presents an unresolved question on the requirements of a member-state opt-out clause permitting voluntary work beyond the 48-hour weekly limit in fire-service shift work. For admissibility, it suffices that the legal question is capable of contributing to the development or clarification of the law; a merits assessment is not yet required (consid. 1).
