Omnilex-Zusammenfassung

The Federal Administrative Court admitted the revision in a dispute about fire-service working time and voluntary overtime beyond 48 hours per week. It held that the complaint raised a question of fundamental importance concerning the requirements for a member-state opt-out rule under Article 22(1) of Directive 2003/88/EC. The prior proceedings were before the Higher Administrative Court of Berlin-Brandenburg and the Administrative Court of Potsdam.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; Art. 22 Abs. 1 RL 2003/88/EG; leave to appeal on grounds of fundamental importance: a revision is to be admitted where the complaint raises a legally unresolved question of general significance that is suitable for clarification in the revision proceedings. For an opt-out regime permitting voluntary overtime beyond the 48-hour weekly limit in fire-service shift work, the decisive point is whether and to what extent the Member State must satisfy the requirements of Article 22(1) of the Working Time Directive; this warrants clarification when the question is relevant beyond the individual case and has not yet been conclusively answered.
