Omnilex-Zusammenfassung

The Federal Administrative Court admitted the revision in a firefighter working-time dispute. It held that the complaint raised a question of fundamental importance: which requirements apply to a member-state opt-out rule under Article 22(1) of Directive 2003/88/EC for voluntary additional shift work in the fire service exceeding 48 weekly hours. The court considered the revision proceedings suitable to clarify this issue.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance. A revision is to be admitted where the case presents a legally clarifiable question of general significance. Such significance exists where the contested legal issue is capable of clarification in the revision proceedings and is not merely fact-specific. This may be the case, in particular, where the interpretation and requirements of Art. 22(1) of Directive 2003/88/EC for a member-state opt-out regime concerning voluntary work in excess of the 48-hour weekly limit are at issue (consid. 1).
