Omnilex-Zusammenfassung

The Federal Administrative Court granted the plaintiff’s complaint against the refusal to admit revision. It held that the case has fundamental importance because revision may clarify whether police overview video recordings made in advance of an assembly amount to an interference with freedom of assembly under Article 8(1) GG. The decision also sets the dispute value for the complaint proceedings and provisionally for the revision proceedings.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; police overview video recordings before an assembly and interference with Art. 8(1) GG: Leave to appeal is to be granted where the case raises a revisable question capable of clarifying whether, and under what conditions, such recordings constitute an encroachment on the freedom of assembly. Fundamental importance exists if the legal issue is unresolved and is decisive for the dispute; it is sufficient that revision may contribute to the clarification of the constitutional dimensions of police observation measures (consid. 1).
