The Federal Administrative Court allowed the plaintiff's revision because the case raises questions of fundamental importance concerning compensatory time off for overtime in the form of standby duty, especially where the service was performed abroad. The court noted that additional related revision proceedings are pending. It also provisionally fixed the value in dispute for the revision proceedings, adopting the appellate court's assessment under the GKG.
§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility on grounds of fundamental importance: A revision is to be allowed where the case presents unresolved legal questions of general significance whose clarification is suitable for the development or uniform application of the law. This may also concern overtime to be compensated by time off in the form of standby duty, including when performed during service abroad; the existence of further pending revision proceedings may support the need for clarification (consid. 1). For the provisional amount in dispute, the court may rely on § 63 Abs. 1 Satz 1 in conjunction with § 52 Abs. 1-3 GKG and adopt the value fixed by the appellate court (consid. 2).

Revisionszulassung; durch Freizeit auszugleichende Mehrarbeit in Form von Bereitschaftsdienst insbesondere bei einer Dienstleistung im Ausland
1 Die Revision der Klägerin ist wegen grundsätzlicher Bedeutung der Rechtssache (§ 132 Abs. 2 Nr. 1 VwGO) zuzulassen. Sie kann dem Bundesverwaltungsgericht Gelegenheit zur Klärung von Fragen geben, die sich im Zusammenhang mit durch Freizeit auszugleichender Mehrarbeit in Form von Bereitschaftsdienst stellen. Dies betrifft insbesondere die bei einer Dienstleistung im Ausland erbrachte Mehrarbeit. Zu diesen Fragen sind beim Bundesverwaltungsgericht weitere Revisionen anhängig (Verfahren BVerwG 2 C 21.15 bis 2 C 24.15, 2 C 28.15 und 2 C 3.16).
2 Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 63 Abs. 1 Satz 1 i.V.m. § 52 Abs. 1, 2 und 3 GKG und entspricht der Streitwertfestsetzung des Berufungsgerichts.
