The Federal Administrative Court admitted the plaintiff's revision. It found that the dispute over the temporal extent of compensatory time off for lawful overtime performed as standby duty raises a question of fundamental importance. The court noted that comparable revisions were already pending in other proceedings, which could allow clarification of the issue. It also provisionally set the amount in dispute for the revision proceedings in accordance with the appellate court's valuation.

Provisional determination of the amount in dispute follows § 63 Abs. 1 sentence 1 in conjunction with §§ 52(1) and (2) GKG and may align with the appellate court's valuation (consid. 2).

1 Die Revision des Klägers ist wegen grundsätzlicher Bedeutung der Rechtssache (§ 132 Abs. 2 Nr. 1 VwGO) zuzulassen. Sie kann dem Bundesverwaltungsgericht Gelegenheit zur Klärung der Frage geben, in welchem zeitlichen Umfang rechtmäßige Mehrarbeit in Form von Bereitschaftsdienst durch Freizeit auszugleichen ist. Zu dieser Frage sind beim Bundesverwaltungsgericht zwischenzeitlich - nach Zulassung der Revision durch das Oberverwaltungsgericht Münster - von der Beklagten des vorliegenden Verfahrens eingelegte weitere Revisionen anhängig geworden (Verfahren BVerwG 2 C 21.15 bis 2 C 24.15).
2 Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 63 Abs. 1 Satz 1 i.V.m. § 52 Abs. 1 und 2 GKG und entspricht der Streitwertfestsetzung des Berufungsgerichts.
