Omnilex-Zusammenfassung

The Federal Administrative Court granted the plaintiff’s complaint and admitted revision. It held that the case raises a question of fundamental importance: whether Saarland’s exclusion of objections under Section 73(4) sentence 3 VwVfG is compatible with EU law. The court referred to the ongoing infringement proceedings initiated by the European Commission and to CJEU case C-137/14 as showing a renewed need for clarification.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility for fundamental significance; compatibility of § 73 Abs. 4 sentence 3 VwVfG SL with Union law. A question is of fundamental significance where a presently decisive legal issue is capable of general clarification and remains in need of clarification; this also applies when Union-law conformity of a procedural preclusion rule is doubtful. Pending infringement proceedings before the Commission and related proceedings before the Court of Justice may underscore the need for clarification, but the decisive point is whether the legal issue is unresolved and relevant to the outcome (consid. 1).

Titelzeile
