Omnilex-Zusammenfassung

The Federal Administrative Court upheld the plaintiff’s complaint against the denial of leave to appeal. It found that the case has fundamental significance because the recurring question whether the objection preclusion rules in § 10(3) sentence 5 BImSchG and § 2(3) UmwRG comply with EU law still requires clarification. The decision also notes the rules on the amount in dispute for the complaint and revision proceedings.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; leave to appeal on the ground of fundamental importance: A complaint is well-founded where the challenged judgment raises a question of law that is again in need of clarification and is capable of clarification in revision proceedings. This applies in particular where the compatibility of statutory objection-preclusion provisions with European Union law is disputed and has not been conclusively settled. The decisive factor is not the correctness of the lower court’s view, but the objective need for clarification in the interest of the uniform development of the law (consid. 1).
