Suspension pending constitutional review of child benefit rule

BFH XI R 7/14Bfh / Division 1121.05.2014Granted

Von Omnilex extrahiert

Omnilex-Zusammenfassung

The BFH stayed the revision proceedings because the constitutionality of Sec. 62(2) EStG was pending before the Federal Constitutional Court in cases 2 BvL 9-14/14 and the disputed provision was decisive for the case. Both parties had requested a stay. The court also held that no costs decision was to be made in connection with the stay.

Omnilex-Regeste

§ 155 FGO i.V.m. § 251 ZPO; suspension of proceedings pending constitutional review: where the constitutionality of a provision decisive for the dispute is already the subject of proceedings before the Federal Constitutional Court, a stay is expedient in particular if both parties request it. In such a case, the appellate court may suspend the revision until the constitutional decision is rendered (consid. 1). No separate costs order is to be made upon ordering the stay (consid. 2).

Titelzeile

(Ruhen des Verfahrens bei gerügter Verfassungswidrigkeit des § 62 Abs. 2 EStG - Keine Kostenentscheidung bei Anordnung der Verfahrensruhe)

Leitsatz

5 2. Eine Kostenentscheidung ist nicht zu treffen (vgl. BFH-Beschluss vom 26. September 2007 X R 54/03, BFH/NV 2008, 66).
