In the constitutional complaint proceedings, the Federal Constitutional Court held that although the complaints were partly dismissed and partly rejected, they had contributed to clarifying questions of fundamental importance. On that basis, the Court ordered the Federal Republic of Germany to reimburse one third of the complainants' necessary expenses. Anordnung der Auslagenerstattung zu einem Drittel (§ 34a Abs 3 BVerfGG) trotz teilweiser Verwerfung bzw Zurückweisung der Anträge in der Hauptsache - Gegenstandswertfestsetzung
Die Bundesrepublik Deutschland hat den Beschwerdeführern ihre notwendigen Auslagen zu einem Drittel zu erstatten.
Der Wert des Gegenstandes der anwaltlichen Tätigkeit der Bevollmächtigten im Hauptsacheverfahren wird jeweils auf 1.000.000 € (in Worten: eine Million Euro) und im Verfahren über den Erlass einer einstweiligen Anordnung jeweils auf 500.000 € (in Worten: fünfhunderttausend Euro) festgesetzt (§ 37 Abs. 2, § 22 Abs. 1 RVG).
1 Die Entscheidung über die Anordnung der Erstattung der Auslagen beruht auf § 34a Abs. 3 BVerfGG. Die Verfassungsbeschwerden sind zwar teilweise verworfen und teilweise zurückgewiesen worden, haben aber in der Sache zur Klärung von Fragen von grundsätzlicher Bedeutung beigetragen (vgl. BVerfGE 36, 146 <173 f.>; 109, 190 <243 f.>; 116, 69 <95>; 130, 1 <51>).
2 Es entspricht der Billigkeit, den Beschwerdeführern die durch das Verfassungsbeschwerdeverfahren entstandenen notwendigen Auslagen in Höhe von einem Drittel zu erstatten.
