Inadmissible constitutional complaint in extradition case

BVerfG 2 BvR 702/17Bverfg / 2. Senat 2. Kammer13.04.2017Inadmissible

Zusammenfassung

The Federal Constitutional Court did not admit the constitutional complaint against the extradition-related decision of the Schleswig-Holstein Higher Regional Court. It held that the complaint did not meet the substantiation requirements under §§ 23(1) sentence 2 and 92 BVerfGG because it lacked adequate engagement with the impugned decision. In addition, essential materials, including the submissions from the specialist-court proceedings, the European Arrest Warrants, and the Romanian assurances regarding detention conditions, were not filed within the complaint deadline or were not sufficiently reproduced. The decision is final.

Regest

§ 23 Abs. 1 S. 2, § 92 BVerfGG; substantiation of a constitutional complaint; a complaint is inadmissible if it does not engage in a sufficiently reasoned manner with the challenged decision and does not substantiate the asserted constitutional violation in a comprehensible way. Documents essential to review, in particular materials from the lower-court proceedings and relevant assurances or warrants, must be submitted or adequately reproduced within the complaint period; otherwise the complaint cannot be considered (cf. consid. on admissibility).

Nichtannahmebeschluss mit Tenorbegründung: Auslieferung des Beschwerdeführers nach Rumänien - Unzureichende Substantiierung der Verfassungsbeschwerde

Tenor
