Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Ungeachtet der Frage der Beschwerdeberechtigung der Beschwerdeführerin (vgl. BVerfGK 20, 333; vgl. aber z.B. auch BVerfGE 96, 231 <243 f.>) und der unzureichenden Darlegung der derzeitigen Beteiligungsverhältnisse an der Beschwerdeführerin genügt die Verfassungsbeschwerde jedenfalls nicht den (übrigen) sich aus § 23 Abs. 1 Satz 2, § 92 BVerfGG ergebenden Begründungsanforderungen.

Nicht jede Verletzung der unionsrechtlichen Vorlagepflicht stellt zugleich einen Verstoß gegen Art. 101 Abs. 1 Satz 2 GG dar. Das Bundesverfassungsgericht überprüft nur, ob die Auslegung und Anwendung der Zuständigkeitsregel des Art. 267 Abs. 3 AEUV bei verständiger Würdigung der das Grundgesetz bestimmenden Gedanken nicht mehr verständlich erscheint und offensichtlich unhaltbar ist (vgl. BVerfGE 135, 155 <231 f. Rn. 180>). Diese Voraussetzungen hat die Beschwerdeführerin nicht hinreichend substantiiert dargelegt. Insbesondere hat sie nicht hinreichend dargelegt, dass Auslegung und Anwendung der Vorabentscheidung des Gerichtshofs der Europäischen Union durch den Bundesfinanzhof im angegriffenen Urteil unvertretbar sind. Darüber hinaus hat die Beschwerdeführerin nicht die Entscheidungserheblichkeit der Frage, ob etwaige Auswirkungen des Sperrbetrags auf die Höhe der Gewerbesteuer mit Unionsrecht vereinbar sind, dargelegt.

Von einer weiteren Begründung wird gemäß § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

Diese Entscheidung ist unanfechtbar.
